Рынок цифровых валют активно развивается во всех странах мира. Вместе с тем правовое обеспечение его деятельности очевидным образом отстает от современных реалий. Россия не является исключением. Так, только в 2021 г. вступил в силу первый в истории нашей страны Федеральный закон «О цифровых финансовых активах, цифровой валюте». Криптовалютам в нем посвящена всего одна статья. В феврале 2022 г. Правительством Российской Федерации на обсуждение общественности была представлена Концепция законодательной регламентации цифровых валют в Российской Федерации. В настоящей публикации рассматриваются основные положения упомянутой выше Концепции, формирующей модель будущей регуляции криптовалют в России. Анализируется правовой статус субъектов, которых планируется задействовать в выпуске и обращении новых цифровых инструментов в России, процедура их приобретения и отчуждения. Также в исследовании приведены примеры публично-правового управления криптовалютным рынком других стран, которые, по мнению автора, достигли наибольших успехов в данной сфере. В результате проведенного анализа делается вывод о том, что предложенная Правительством РФ юридическая модель выпуска и обращения цифровых валют не будет способствовать развитию криптовалютного рынка в России. Она обладает такими недостатками, как громоздкость, длительность и дороговизна совершения криптовалютных сделок. По этой причине вносятся предложения о корректировке проекта правового регулирования криптовалют в Российской Федерации.
The digital currency market is actively developing in all countries of the world. At the same time, the legal support of its activities obviously lags behind modern realities. Russia is no exception. So, only in 2021, the first Federal act “On Digital Financial Assets, Digital Currency” in the history of our country came into force. There is only one article devoted to cryptocurrencies in it. In February 2022, the Government of the Russian Federation presented the Concept of Legislative Regulation of Digital Currencies in the Russian Federation for public discussion. This publication is devoted to the analysis of the main provisions of the Concept mentioned above, which forms a model for the future regulation of cryptocurrencies in Russia. Thus, the author analyzes the legal status of entities that are planned to be involved in the issuance and circulation of new digital instruments in Russia, the procedure for their acquisition and alienation as well. The study also provides examples of public law management of the cryptocurrency market in other countries, which, according to the author, are the most advanced in this sphere. As a result of the analysis, the author came to the conclusion that the legal model for the issuance and circulation of digital currencies proposed by the Government of the Russian Federation will not contribute to the development of the cryptocurrency market in Russia. It has such disadvantages as bulkiness, long duration and high cost of accomplishing of crypto transactions. For this reason, proposals are being made to adjust the draft of the legal regulation of cryptocurrencies in the Russian Federation.
